Take Your Butt Outside

Permitting smoking in the workplace is illegal and could result in a fine of $300 or more.  Employers in Ontario must ensure compliance with the Smoke-Free Ontario Act.

Employers must:

  • Determine where smoking is illegal under the Smoke-Free Ontario Act.

  • Advise all employees of how the law affects your workplace.

  • Post "No Smoking' signs at all entrances, exits and throughout the workplace including in all work vehicles.

  • Ensure compliance with the Smoke-Free Ontario Act.  Enforce smoking regulations and internal policies and respond to employee complaints in a timely manner.  Contact your local Public Health Unit for assistance with complaints, policies and/or enforcement.

It is illegal for an employer or person acting on their behalf to dismiss, discipline, suspend, penalize, intimidate or coerce any employee who has sought enforcement of the Smoke-Free Ontario Act.
